Our client, a professional and dynamic corporation is growing! They are looking for an experienced and knowledgeable Family Law Clerk to join its team to work as a Legal Risk Analyst.

In this role as a Legal Risk Analyst you will be responsible for assessing family law financing loan applications, providing written analysis outlining entitlement, likelihood of recovery and, identification of any risk with a strong emphasis on the ability to establish and maintain positive relationships with both the law firm clients (lawyers/support staff) and loan applicants.

Strong experience managing family law files from intake to full resolution settlement including, drafting court documents, performing family law support and equalization payment calculations, providing advice/opinions to the lawyer with carriage, managing client requests and handling accounting matters related to file management with the ability to identify issues within the file, assess quantum and potential recovery on an individual file basis. Knowledge of the housing market, and real estate matters such as liens, capital gains, mortgage and title documents, is an asset. Experience in Estates and/or Estate Litigation would be considered an asset.

Key Responsibilities

Relationship Management

Interaction with external clients and law firms with respect to loan inquiries and applications
Educate external clients and law firms on loan processes, terms and product options
Commitment to providing excellent customer service to build and maintain strong relationship
Participating in various marketing initiatives including conferences, presentations to law firms, attendance at various networking events
Work with internal teams such as sales and credit to identify opportunities within law firms, prepare and present product information to law firms to increase education of family law product including attending meetings, providing introductions as required and working as a team to grow the product and develop same to maximum benefit and utilization

Risk Assessment

Receive and act on loan applications from external clients and law firms, discussing same with both the applicant and counsel, requesting the appropriate information/documentation to complete due diligence and an assessment of the claim
Diligent use of third-party software tools to search title of property, review mortgage documents/statements, perform credit checks and interpret results to use in due diligence related to assessment process
Provide written reports and recommendations for financing of a client, including identification of risks and quantum of claim
Implement and follow monitoring initiatives for family law files including putting third parties on notice of loan, as applicable to each individual file to ensure security interest
Knowledge of law firm accounting structures, accounting principals and trust/general account operations
Monitor the progress of legal claims that remain outstanding where company has ongoing security interest
Monitor and evaluate new developments in family law that may have an impact on the business activities undertaken by company in the jurisdictions in which is operates
Work with the legal team in situations where amendments may be required to loan documents in relation to the specific file scenario in order to ensure risk of recovery is mitigated and security is maximized
Liaise with legal team relating to problem loans when/if they may arise by proactively identifying possible recovery issues, discussing and putting other departments on notice of same and assisting with facilitating required steps as required
Constant communication with team members to ensure excellence in client experience

Continuous Improvement

Assist in identifying and implementing process improvements and control procedures
Legal research and monitoring trends in family law decisions at both court and tribunal levels
Participating in and identify continuing legal education and internal training opportunities

Education

College Diploma or Degree from a recognized Law Clerk or Paralegal program

Skills & Qualifications

Post-secondary education and qualification as a Law Clerk and/or Paralegal
7+ years’ experience working as a Law Clerk and/or Paralegal in family law
Preference will be given to those with experience in estates and estates litigation; personal injury would be an asset
Solid background in/understanding of family law and the differences between exposure and realistic recovery values
General knowledge of technicalities of family law matters including spousal and child support, asset and pension splitting, business evaluations/interests in same, common law versus marriage breakdown differences and implications as related to the dissolution and resolution of all issues related to same
Experience within a collaborative family law practice would be an asset
Knowledge of family law procedures and asset dissolution and resolution in other provinces would be an asset
Excellent written and verbal language skills with attention to detail
Strong analytical, time management and organizational skills
Exceptional ability to work well under pressure, efficiently handling multiple tasks and a strong ability to prioritize
Possess strong interpersonal and business development skills to maintain customer relationships with client companies
Possess advanced computer skills; ability to learn new processes and tools quickly is essential
Strong work ethic with ability to work both independently and as a team member
Team player - ability to work with people from multiple teams
