Job Summary
A great opportunity to put your trial experience to work balancing the information access and privacy concerns of the Freedom of Information and Protection of Privacy Act in a criminal law context
The BC Prosecution Service (BCPS) helps protect society by independently, effectively, and fairly conducting prosecutions and appeals at all levels of court. BCPS Crown Counsel pre-approve charges and prosecute offences under the Criminal Code, provincial statutes and regulations, and federal statutes, in accordance with BCPS policies and the Crown Counsel Act.
The BCPS also provides legal advice to government and police on criminal law matters, develops policies and procedures on issues relating to the administration of criminal justice, and liaises with the media and members of the public on all matters respecting the work of the BCPS. The Assistant Deputy Attorney General is responsible for the administration of the BCPS, which is divided into Headquarters, Criminal Appeals and Special Prosecutions (CASP) and five regions, each of which is headed by a Regional Crown Counsel.
The Information Access and Privacy Crown Counsel at Headquarters is responsible for responding to requests for access to BCPS records under the Freedom of Information and Protection of Privacy Act (FOIPPA), for a "decentralized" branch which responds directly to requests, by making decisions on the release of information and the protection of privacy. This includes responding to complaints, reviews, and inquiries by the Office of the Information and Privacy Commissioner.
Further responsibilities of the position include the development and implementation of BCPS policies and guidelines regarding information management, access and privacy, and providing legal opinions as new issues arise regarding the sharing of information with other public bodies and/or jurisdictions.
As a part of the Policy and Justice Issues team, this role supports the work of the Director, Policy and Justice Issues, to contribute to various ministry, intra-governmental, and inter-governmental committees relating to criminal justice policy and reform, with a particular focus on privacy and information management.

Job Requirements:
  • Must be a member of the Law Society of British Columbia in good standingORimmediately eligibilityfor call to the British Columbia Bar
  • Crown Counsel Level 2: Counsel in their 6th to 11th year of call, with a minimum of two (2) years of recent experience as a practicing lawyer in Canada, including in the area of criminal law
  • Crown Counsel Level 3: Counsel in their 12th year of call or greater, with a minimum of two (2) years of recent experience as a practicing lawyer in Canada, including in the area of criminal law

Preference may be given to the following:
  • Lawyers with eight (8) or more years of experience in the practice of criminal law
  • Lawyers with four (4) or more years of Crown Counsel experience
  • Lawyers with experience working with information access and privacy legislation

Provisos
  • Travel may be required
  • Must be willing to deal with disturbing cases, including images of child sexual assault and child sexual abuse
  • Must be willing to deal with victims and witnesses who have been subjected to or witnessed traumatic events, including sexual abuse, catastrophic injuries, and death, or have suffered other forms of extreme personal loss
  • Must be willing to deal with traumatic violence or death scenes including images of and evidence about deceased persons with catastrophic injuries
  • Must be willing to manage sensitive, graphic, and highly confidential information and be the object of negative public or media comment or criticism with limited ability to respond.

About this Position:
Flexible work options are available; this position may be able to work up to 3 days at home per week subject to an approved telework agreement.
An eligibility list may be established to fill future temporary and permanent vacancies.
Employees of the BC Public Service must be located in BC at the time of employment.
COMPENSATION
  • CR CNSL 2 - $156,056.80 - $202,384.88 annually
  • CR CNSL 3 - $208,401.59 - $239,317.93 annually
