The BC Prosecution Service (BCPS) contributes to the protection of society by preparing for and conducting prosecutions diligently and fairly. The BCPS prosecutes offences under the Criminal Code of Canada, the Youth Criminal Justice Act and provincial statutes in the provincial, Supreme and Appeal Courts of British Columbia and in the Supreme Court of Canada. The BCPS provides legal advice to government and police on criminal law matters and develops policies and procedures on issues relating to the prosecution of criminal justice. The Assistant Deputy Attorney General (ADAG) is responsible for the administration of the BCPS, which is divided into Headquarters, Criminal Appeals and Special Prosecutions (CASP) and five regions which are headed by a Regional Crown Counsel.
Criminal Appeals and Special Prosecutions (CASP) is looking for the next Deputy Director, Prosecution Support Unit.
The Deputy Director, PSU, is a senior member of the BCPS, a member of the Regional Management Committee and reports to the Director of CASP. This position will perform leadership and management functions, as well as assume administrative and legal duties.
The Deputy Director, PSU, will lead and provide management oversight in relation to the following areas within CASP: bilingual prosecutions; constitutional litigation and constitutional advice within the BCPS; act as a liaison on constitutional issues between the BCPS and the Legal Services Branch; and co-ordinate and provide advice to the BCPS on Notices of Constitutional Question served on the Attorney General in relation to criminal cases; and specific advice respecting firearms, extraditions and issues revolving around court appointed counsel.
The Deputy Director, PSU will be expected to manage their own caseload, provide advice to Crown Counsel, within and outside CASP, who have conduct of constitutional, extradition, firearms and appointed counsel issues arising in criminal cases, and provide legal advice and support to Management Committee on those issues arising at all levels of court.
CASP is responsible for the following areas of practice:
(1) all indictable criminal appeals undertaken to the Court of Appeal for British Columbia and the Supreme Court of Canada, [Criminal Appeals Section];
(2) prosecutions involving commercial crime, allegations against police and regulatory offences including environmental and workplace injury and fatality related prosecutions [Commercial, Police, & Regulatory Prosecution Section];
(3) organized and major crime prosecutions;
(4) CASP is also responsible for providing prosecutorial litigation support to other prosecution offices within the BCPS in respect of constitutional challenges that arise in the trial courts [Prosecution Support Unit];
(5) CASP is also responsible for the delivery of legal resources and learning and development opportunities for the BCPS.
(6) CASP is also responsible for coordinating French and bilingual prosecutions

Compensation includes:

Job Requirements:
Education and/or Occupational Certification:
  • Membership in good standing with the Law Society of British Columbiaor immediate eligibility for call to the British Columbia Bar.

Experiences and/or Achievements
  • Counsel with at least 10years of criminal law related practice.
  • Counsel with at least 8 years of Crown Counsel experience.
  • Counsel with experience in prosecuting complex trials or appeals.

Preference may be given to the following:
  • Applicants with substantial practical experience in the litigation of constitutional issues arising in criminal cases.
  • Applicants with experience appearing before the Supreme Court of Canada.
  • Applicants with experience in the development and delivery of legal education.
  • Applicants with experience in effectively leading and/or managing legal counsel and Professional Staff.
  • Applicants who speak, and are competent to conduct trials in, French.

Provisio:
  • Travel is a requirement. Transportation arrangements must meet operational requirements of the ministry.
  • Work outside regular business hours may be required.
  • You must submit to and successfully pass the Enhanced Security Screening (ESS) and Criminal Records Review Act (CRRA) check. Security Screening and Criminal Record Review Act checks will be conducted periodically and at least every five years.

About this Position:
Flexible work options are available; this position may be able to work up to 2 days from home a week subject to an approved telework agreement.
Criminal Appeals and Special Prosecutions (CASP) has one Deputy Director, position available in the Prosecution Support Unit.
An eligibility list may be established for future temporary and/or permanent opportunities.
This position is excluded from union membership.
This position is excluded from the BC Crown Counsel Association.
