Job description

The Litigation Clerk/Paralegal is accountable to the General Counsel and Associate General Counsel for a wide range of residential and litigation related legal matters. In particular, the Litigation Clerk / Paralegal will be entrusted with protecting and advocating for the interests of the company and its clients before a number of tribunals and courts.

DUTIES AND RESPONSIBILITIES

Document Preparation - Prepare various forms and notices as required by the Residential Tenancies Act, 2006, and draft pleadings, affidavits, and other related documents. Ensure all filings comply with rules and deadlines. Maintain a clear and well-organized document management system.

Legal Research - Conduct legal research and interpret relevant legislation, regulations, and case law. Prepare memoranda for the General Counsel and other departments, as necessary. Review and proofread documents and drafts to ensure compliance with court rules.

Litigation Management - Investigate complaints, obtain evidence, and take the initiative to ensure the company is acting in compliance with its legal and regulatory obligations. Attend Small Claims Court and the Landlord and Tenant Board to adjourn matters, obtain consent orders and conduct hearings. Facilitate the enforcement of eviction orders, rent arrears orders and other judgments, including garnishments.

Business Support - Provide advice and counsel to the business team as required. Develop tailored tenant dispute resolution strategies that align with organizational goals, prioritizing customer/tenant service while mitigating legal risks.

Reporting and Information Management - Assist with administrative and clerical task as needed. Maintain records of communications, court appearances, orders, and other related activities. Monitor calendar and hearing schedule. Prepare reports and updates for the legal team and other business departments as necessary.

Policy and Procedure Development - Foster collaboration across various business units and assist the legal team in developing and updating internal polices and procedures related to residential tenant dispute management and related issues. Keep up to date with legal and regulatory obligations.

External Counsel Management - Act as a liaison for external counsel on litigation matters, primarily Landlord and Tenant matters, to ensure timely and efficient service to all business units.
Any other job related duties and/or projects that may be assigned.
Minimum Requirements

Skills, Knowledge, Experience and Education

  • Paralegal designation or equivalent
  • Minimum 4 years of experience dealing with tribunals and courts
  • Experience with the Residential Tenancies Act, 2006 and the Rules of the Small Claims Court Regulation
  • Proficient legal research, writing and verbal communication skills
  • Strong computer skills, including proficiency in Microsoft Office Suite
