ELIGIBILITY FOR THIS COMPETITION IS RESTRICTED TO STEP 1 CANDIDATES INCLUDING OPS ALOC AND OCAA LAWYERS living or working within 125 km of this location. Note: Eligible lawyers from outside the Area of Search may apply but will not be entitled to relocation or travel expenses for the transfer as set out below.
 Step 1: All regular/fixed-term OCAA and ALOC lawyers on staff, current Redeployment List Members and current Articling Student Hireback Pool Members. 
Step 2: In the absence of qualified applicants at Step 1 the competition may be reposted so that external applicants or non-members of the above-mentioned groups would then be eligible to apply.

Our Legal Services Branch provides litigation services to the Ministry of Labour, Immigration, Training and Skills Development (MLITSD), the Ministry of Public and Business Service Delivery (MPBSD), and the Ministry of Long Term Care (MLTC).
As Crown Counsel with the branch you will have the opportunity to be involved in a variety ofProvincial Offences Act (POA) prosecutions, administrative appeals, Judicial Reviews and Coroner's Inquests; as well as to provide advice, training and litigation support for these three ministries.

What can I expect to do in this role?

Duties will include:
• Conducting prosecutions under the Occupational Health and Safety Act , theEmployment Standards Act, theOntario Immigration Act, theBuilding Opportunities in the Skilled Trades Act, theConsumer Protection Act, and theFixing Long-Term Care Act
• Representing MPBSD at appeals before the Licence Appeal Tribunal
• Representing MLITSD at appeals before the Ontario Labour Relations Board
• Appearing before Ontario courts on Provincial Offences Act appeals and Judicial Reviews
• Attending Coroners' Inquests on behalf MLITSD
• Providing critical enforcement- and compliance-related advice to MLTC and its inspectorate with respect to a new regulatory statute
• Providing litigation support, training and advice to the client ministries
• Participating in committees and administrative duties, as needed
• Participating in special projects, as needed
• Travel throughout the Province of Ontario

How do I qualify?

Mandatory

• Membership in good standing as a lawyer with the Law Society of Ontario

Knowledge and Skills

• In-depth knowledge of and extensive litigation experience in POA and/or criminal prosecutions
• In-depth knowledge of and extensive litigation experience in administrative law and procedure
• In-depth knowledge of the rules of evidence and the Charter of Rights and Freedoms
• In-depth knowledge of the roles and responsibilities of Crown counsel
• Experience with the rules of civil procedure and civil litigation, including applications for judicial review
• Proven ability to function well under the pressure of timelines and unexpected demands
• Proven judgment and analytical skills
• Demonstrated communication skills
• Demonstrated writing skills and computer literacy, including use of Word, Outlook, Excel and PowerPoint
• Ability and willingness to travel throughout Ontario as required
