Job Summary

WCAT is an independent, quasi-judicial tribunal that workers or employers can go to if they want to appeal a decision from WorkSafeBC. WCAT is the final level of appeal in the B.C. workers' compensation system. It has authority to decide appeals about specific types of work-related matters outlined in section 288 and 289 of the Workers Compensation Act .To learn more about WCAT, please visit www.wcat.bc.ca .
WCAT is seeking a Legal Counsel to work as part of a team representing the tribunal with respect to the hearing of Petitions for judicial review and related appeals before the Superior Courts, conducting research and analysis on specific or general legal questions, and providing legal opinions to the Chair and Vice Chairs, particularly in the areas of workers' compensation and administrative law. The Legal Counsel also provides research on policy and other administrative matters and participates in WCAT's in-house continuing professional development program.
Job Requirements:
  • Law degree and admission to the Bar in British Columbia (or immediate eligibility for admission), preferably with 6 to 11 years of call
  • Experience in judicial review, and/or other courtroom work
  • Experience in legal writing and research, providing advice and preparing legal opinions including complex issues of statutory interpretation
  • Experience in administrative law and workers' compensation law preferred

About this Position:
Flexible work options are available; this position may be able to work up to 3 days at home per week subject to an approved telework agreement.
An eligibility list may be established to fill future temporary and permanent vacancies.
Employees of the BC Public Service must be located in BC at the time of employment.
Legal counsels are required to join the Professional Employees Association. Details about the terms and conditions of employment is available on MyHR at Collective agreements - Province of British Columbia (gov.bc.ca) . When a collective agreement is negotiated between the PEA and the Province of British Columbia to include government Legal Counsel, terms and conditions in that collective agreement will be binding.
