Overview
We are looking for a Manager, Compliance and Field Investigations to manage the Compliance and Field Investigations sections within the Legal Services Division as a practising member of the Law Society of British Columbia. In this role, you'll report to the Senior Manager, Compliance and Field Investigations, and lead managers and staff in the provision of legal advice to WorkSafeBC officers, staff and management on matters including: the investigation, issuance, and adjudication of OHS orders and administrative penalties; the investigation of serious violations of the Workers Compensation Act and other legislation which may lead to the referral of quasi-criminal charges to the BC Prosecution Service; the adjudication of worker health & safety discrimination complaints; and general legal advice on prevention-related legislation, regulations, WorkSafeBC policy, and law.
In addition, the incumbent supports the development of Field Investigation strategies, policy, and practice by directing assigned staff to ensure the effective delivery of services and implementation of WorkSafeBC and Divisional policies and programs. The primary function of the department is to investigate serious violations of the Workers Compensation Act and fraudulent activities against the workers' compensation system.

Where you'll work
At WorkSafeBC, we offer a hybrid work model that combines the convenience of working remotely with the dynamism of working in one of our offices, based on the operational needs of the position.
In this role, you'll work primarily from your B.C. home and occasionally in our Richmond office.
What you'll do
  • Manage the Compliance and Field Investigations sections in order to effectively plan and deliver services to both internal and external clients and customers.
  • Provide legal advice, guidance and direction to managers and staff in the division and to others outside the division including:
  • providing legal advice to WorkSafeBC officers and management on criminal and regulatory law;
  • analyzing investigation materials to ensure that all necessary facts and evidence have been gathered and ensuring that all related documentation and evidence gathered by WorkSafeBC officers will meet legal requirements;
  • ensuring quasi-criminal investigations are conducted in a timely manner, meeting applicable statutory limitation periods under the Workers Compensation Act;
  • preparing and presenting written and/or oral submissions to various decision makers on behalf of WorkSafeBC;
  • preparing legal documents such as, but not limited to, case briefs, subpoenas, agreed statements of fact, consent orders, and settlement waivers;
  • reviewing Reports to Crown Counsel (RTCC) to the BC Prosecution Service for the purpose of seeking charge approval;
    • Lead the effective delivery of Compliance and Field Investigations services and programs by developing and implementing departmental business plans to support and achieve the division's strategic objectives and performance goals. Monitor and adjust activities to meet business plan objectives and to respond to changing conditions.
    • Provide leadership to ensure that WorkSafeBC and divisional policies, procedures and standards are appropriately implemented within assigned area.
    • Lead assigned staff to ensure high levels of service are achieved in meeting organizational and divisional priorities and objectives. Hires, orients, evaluates, disciplines and terminates staff as required. Assigns work to managers and staff, sets performance goals and provides feedback, coaching and developmental planning to support and motivate managers and staff in exceeding expectations.
    • Work with other divisions and WorkSafeBC senior management as a legal advisor on Compliance and prevention-related issues.
    • Promote a service-oriented approach in providing services to external and internal clients. Lead staff to identify, follow up, and respond to customers and clients needs and areas of concern, taking appropriate action to quickly resolve issues.

    We're looking for someone who can:
    • Participate, as a member of the management team of the division, in policy and practice development, and in operational and business planning activities, implementing changes and initiatives as required. Work closely with and in collaboration with other divisional executives, and WorkSafeBC managers and staff in planning, program development, or operational activities.
    • Create a supportive and healthy working environment within the department by providing support, ensuring effective communication, promoting teamwork, and recognizing employees' contributions and achievements. Assist and support staff as changes and new initiatives are implemented in the workplace.
    • Foster a constructive labour relations environment within the department by dealing proactively with issues. Administer the provisions of the collective agreement and handles grievances at the informal level.
    • Manage the financial resources within the allocated budget. Support the planning and development of annual operating budget for the assigned area. Monitor ongoing financial reporting, investigate variances and take corrective action as required.
    • Implement the provisions of WorkSafeBC's Corporate Health, Safety, and Wellness policies within assigned area, including performing regular safety inspections, reporting real or potential hazards, holding regular safety meetings, and conducting accident investigations.
    • Promote the strategies and objectives of WorkSafeBC and the division within and outside of the organization. May represent WorkSafeBC and the division with external stakeholders and agencies as required.
    • Maintain current knowledge in the fields of administrative law, quasi criminal law, Workers' Compensation Act and Regulations and WorkSafeBC policies and practices by reviewing relevant materials and journals and maintaining appropriate professional contacts.

    Your background and experience
    • A Law Degree (LLB or JD)
    • A member in good standing of The Law Society of British Columbia
    • 7 years' experience in practice with experience in primarily criminal law and/or administrative law.
    • In-depth knowledge of Part 3 of the Workers' Compensation Act and related WorkSafeBC Prevention policies and practices.
    • Strong and proven leadership, management and/or supervisory experience required.
